We advised Carbones del Cerrejón Limited (Glencore), multinational which is the largest mining company in Colombia, during the execution of a construction project which involved marine works and structures.
We played a significant role advising the owner regarding contractor’s (Ferrovial Agroman and Sainc Ingenieros) attempt for early termination of the contract and its later abandonment of the project. Thereafter, the disputes were submitted to an ICC international arbitration, under Colombian law. The tribunal dismissed all claims (USD$60 million dollars) brought by the contractor and awarded all counterclaims and damages sought by Cerrejón (USD$40 million dollars). Consequently, the Tribunal ordered the contractor paying 100% of both the costs of the arbitration and of the costs of Cerrejón’s legal representation.
